Terms and Conditions (T&C)

§1 Scope of Services
These Terms and Conditions apply to all services provided by ShakeParty, including children's entertainment, mascot appearances, workshops, birthday parties, school enrollment celebrations, corporate events, weddings, city festivals, summer parties, and other event services.
Any differing terms proposed by the customer shall only apply if expressly agreed to in writing.
§2 Contract Formation
A contract is concluded once ShakeParty confirms the booking and the agreed deposit has been received.
By placing a booking, the customer accepts these Terms and Conditions.
§3 Prices and Payment
The prices agreed upon at the time of booking shall apply.
Travel costs are calculated individually and specified in the respective quotation.
The remaining balance must be paid on the day of the event unless otherwise agreed in writing.
§4 Services Provided
Descriptions of programs and packages are provided for guidance only.
Depending on the age of the children, group size, weather conditions, venue restrictions, or other circumstances, the program may be adapted by the entertainer on-site.
The customer is not entitled to demand specific games, activities, or a particular sequence of program elements.
§5 Event Venue
The customer is responsible for ensuring that the booked services may legally and practically be carried out at the chosen venue.
Any required permissions from the venue owner, restaurant, hotel, park, or other location must be obtained by the customer.
§6 Supervision of Children
Parents, legal guardians, or designated supervisors remain fully responsible for supervising all participating children throughout the event.
ShakeParty entertainers and staff do not assume any supervisory duties.
§7 Customer Delays
If the event starts late due to the customer or if participants are not ready at the agreed time, the performance time will be reduced accordingly.
There is no entitlement to an extension of the booked service time.
§8 Weather Conditions for Outdoor Events
For outdoor events, the customer must provide a suitable indoor or weather-protected alternative location.
If the event cannot be carried out due to the lack of an appropriate alternative location, any costs already incurred shall remain payable.
§9 Cancellation and Rescheduling
Events may be rescheduled free of charge up to 14 days before the agreed event date, subject to availability.
For cancellations made more than 14 days before the event, any deposit paid will be refunded.
For cancellations within 14 days of the event date, the deposit will be retained.
For cancellations within 48 hours of the event, 50% of the agreed total fee becomes payable.
§10 Force Majeure
If the event cannot be performed due to illness of a performer, traffic accidents, government restrictions, natural disasters, or other circumstances beyond our control, ShakeParty will inform the customer as soon as possible.
In such cases, payments already made will either be refunded or transferred to a replacement date at the customer's request.
§11 Photography and Video Recording
Photography and video recording by ShakeParty will only take place with the customer's prior consent.
Publication of photos or videos for marketing or social media purposes requires separate approval.
§12 Safety and Conduct
If any participant is under the influence of alcohol or drugs, behaves aggressively, or poses a risk to the safety of our staff, ShakeParty reserves the right to terminate the event immediately.
In such cases, the agreed fee remains payable in full.
§13 Gift Vouchers
Gift vouchers and promotional prizes cannot be exchanged for cash.
Gift vouchers are valid for three years from the date of issue.
§14 Limitation of Liability
ShakeParty shall only be liable for damages caused intentionally or through gross negligence.
Liability for minor negligence is excluded to the extent permitted by law.
§15 Final Provisions
Should any provision of these Terms and Conditions become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
The laws of the Federal Republic of Germany shall apply exclusively.
